Importers win refund battle in US Trade Court

Mar 9, 2026

A ruling by the United States Court of International Trade has cleared the way for thousands of companies to receive refunds for tariffs previously imposed by Donald Trump under the International Emergency Economic Powers Act (IEEPA). Judge Richard Eaton ordered US Customs and Border Protection to process refunds following a decision by the Supreme Court of the United States that struck down the tariffs last month. The judgment arose from a case filed by Atmus Filtration Technologies but applies to all importers whose shipments were subject to IEEPA duties. The tariffs, introduced in 2025, generated roughly $130 billion for the government and affected a wide range of imports. Major companies, including FedEx, have sought full reimbursement. Meanwhile, Treasury Secretary Scott Bessent indicated the administration may introduce a new 15% global tariff to replace the invalidated duties, keeping uncertainty high for global trade and supply chains, according to a report.
